Article 2 — Scope

These terms and conditions apply to all orders placed on lamaisonlouis.fr by non-professional consumers residing in mainland France. Placing an order implies full and unreserved acceptance of these terms, in accordance with article L221-5 of the French Consumer Code.

Article 3 — Food products — Information obligations (INCO Regulation)

In accordance with Regulation (EU) No 1169/2011 on the provision of food information to consumers (INCO), applicable to online sales, each label and/or product page states:

  • The sales name of the product
  • The list of ingredients, with the 14 major allergens highlighted
  • The net quantity
  • The use-by date or the best-before date
  • Any special storage and usage conditions
  • The name and address of the manufacturer or packer
  • The country of origin or place of provenance (mandatory for pork, poultry, sheep and beef, and since 2025: nuts, dried fruits and lightly processed products)
  • The nutrition declaration

This information is available on the labelling of the products delivered and/or on each product page.

Article 4 — Sale of alcoholic drinks — Specific regulations

Maison Louis holds the off-licence (grande licence à emporter — all categories of alcohol) issued by the town council of Capens, in accordance with articles L3331-1 et seq. of the French Public Health Code. Distance selling of alcohol is treated as off-sales (article L3331-4 of the same Code).

Alcoholic drinks are offered within composed gift boxes and hampers, and also individually for online sale and in our shop in Capens.

Mandatory notices (Loi Évin no. 91-32 of 10 January 1991):

  • Alcohol abuse is dangerous for your health — please drink responsibly
  • The sale of alcohol to persons under 18 is prohibited
  • Pregnant women should not consume alcoholic drinks

Age verification: for any order including a gift box containing alcoholic drinks, or such drinks sold individually, the buyer must confirm being of legal age (18 or over) before the order is validated, by means of a mandatory declaration of age at the time of ordering (unticked box: “I certify that I am 18 or over”). Maison Louis reserves the right to refuse or cancel any order where the buyer is suspected of being a minor.

Breathalysers: in accordance with the French order of 30 March 2021, Maison Louis offers breathalysers for sale on its website and in its shop.

Article 5 — Prices

Prices are shown in euros, inclusive of VAT. Delivery charges are clearly displayed before the order is validated (article L221-5 of the French Consumer Code). Maison Louis reserves the right to change its prices; the applicable price is the one in force at the time of validation.

Article 6 — Orders

An order is validated once payment has been confirmed. A summary confirmation email is sent in accordance with article L221-14 of the French Consumer Code. Maison Louis reserves the right to cancel any order in the event of a stock shortage, a pricing anomaly or suspected fraud, with a full refund within 14 days.

Article 7 — Payment

Secure online card payments via PAYPLUG (TLS encryption). Card details are never stored on our servers; all payments are secured and guaranteed by 3D Secure technology and two-factor authentication from your bank.

Article 8 — Delivery

Dispatch by carrier within 24 hours, to mainland France only. Free delivery on orders over €90 incl. VAT. Timescales are given as an indication. In the event of delay, you may cancel the order if delivery does not take place within a reasonable additional period (article L216-6 of the French Consumer Code), with a refund within 14 days.

Article 9 — Returns and withdrawal policy

In addition to this article, further information is available on our page setting out our refunds and returns policy for purchases made on our website.

9.1 — Perishable products (excluded from the right of withdrawal)

In accordance with article L221-28 2° of the French Consumer Code, the right of withdrawal is excluded for the following perishable foodstuffs:

  • Semi-cooked foie gras, chilled terrines and pâtés
  • Fresh charcuterie (rillettes, vacuum-packed hams with a short use-by date)
  • Any product with a use-by date of less than 30 days
  • Gift boxes and hampers containing one of these perishable products

These perishable products are available in our shop only and are therefore not shipped.

9.2 — Non-perishable products (14-day right of withdrawal)

For products with a best-before date of more than 30 days, you have 14 days from receipt to exercise your right of withdrawal, without giving any reason (article L221-18 of the French Consumer Code). This applies to:

  • Sterilised canned goods (cassoulet, garbure, tinned terrines, tinned foie gras)
  • Airtight glass jars
  • Dry goods (lentils, packaged Tarbais beans)

Return conditions:

  • Product unopened, in its intact original packaging
  • Product undamaged and in resaleable condition
  • Prior notification by email to lemarchedeslouis@gmail.com
  • Return at your expense to: Maison Louis, 9 bis rue des Vieilles Vignes, 31410 Capens, France. The return must be sent within 14 days at the latest of the notification (article L221-24 of the French Consumer Code)

Refund: in full (product + standard outbound delivery charge) within 14 days of receiving the return, using the same means of payment (article L221-24 of the French Consumer Code).

9.3 — Damaged or non-conforming product

Should a product be damaged in transit, missing, or not conform to your order (whether perishable or not), contact us within 3 days of receipt at lemarchedeslouis@gmail.com, enclosing:

  • Photographs of the outside of the parcel (including the reservations written on the delivery note, where applicable)
  • Photographs of the products concerned
  • Order number

Depending on your preference, we will issue a full refund or send a replacement within 14 days, in accordance with the legal guarantee of conformity (articles L217-4 et seq. of the French Consumer Code).

9.4 — Alcoholic drinks

Alcoholic drinks included in gift boxes follow the regime of the box itself:

  • If the box contains a perishable product: no return is possible (article 9.1)
  • If the box is made up entirely of non-perishable products: return is possible if unopened and undamaged (article 9.2)

Under no circumstances may an opened bottle or flask be returned or refunded.

Article 10 — Legal guarantees

  • The legal guarantee of conformity applies to our products. For foodstuffs, it applies within the limit of the use-by date (DLC) or best-before date (DDM) shown on the product (articles L217-3 to L217-20 of the French Consumer Code).
  • Guarantee against hidden defects (articles 1641 et seq. of the French Civil Code)

Article 11 — Mediation

In accordance with art. Article 12 — Governing law and contract language

These terms and any contract entered into with Maison Louis are governed by French law.

In accordance with Article 6 of Regulation (EC) No 593/2008 (“Rome I”), this choice does not deprive a consumer residing in another European Union member state of the protection afforded by the mandatory provisions of the law of their country of residence.

This site is published in French, English and Spanish. The translated versions are provided for the reader’s convenience. In the event of any discrepancy in interpretation, the French version shall prevail.
